We had a great turn out last night! I really appreciated the Transgender Law Center coming out to help us. So many things have changed in the law recently it was nice to finally get it straight.
If you missed the meeting, or want a refresher, you can go to the Transgender Law Centers website at: http://www.transgenderlawcenter.org/ Under "Quick Links" select from the drop down menu, "California Transgender Law 101: A resource guide" It will download a copy immediately. This is the handout we got last night and includes many of the forms you will need. Then go view an hour long video of the presentation at http://www.transgenderlawcenter.org/translaw101.html It is well worth the time!
A couple of key points I thought were important from last night. * It's best to get your court ordered name change first before getting your Drivers license changed, due to recent changes in the laws. * If you're poor, you can apply for a fee waver for the court so you don't have to pay the filing fees, which can be up to 300.00 I think. * When you go to your Court hearing for your name change, the court is only allowed to ask you two questions, "If you are who you say you are and if the info on your paperwork is accurate". If you have a problem with the Court and your name change, contact TLC directly. * Changing your gender on your drivers license remains the same as before, you will have to have your doctor fill out the DL 328. (The number of this form may change soon) * If you want to change your gender marker through the Court and don't have the money for full sex reassignment or choose not to have certain procedures, any surgical gender change is adequate. Like chest surgery, hysterectomy, orchidectomy, as well as SRS. And on some rare occasions if you are unable to have surgery because the surgery is likely to kill you, you can have the Transgender Law Center advocate on your behalf to get the marker changed without surgery. Contact TLC directly for more info if you are such a person. * A personal note : Remember guys if you have insurance, get your procedure completed before you change your gender marker with Social Security because your insurance company will not pay for a "man" to have hysterectomy.
* Other extremely important documents we should all have are: * Memorandum of Understanding (as a spouse and as a parent) helps prevent legal attacks due to your gender change.
* Financial Power of Attorney * Health Care Directive * and a Will. Without these three documents, if a family member is called upon to make decisions for you, they do not have to respect your new gender. So get these documents taken care of, so your new gender is protected!
